Contest Terms and Conditions

Contest Rules  

CONTEST: Each contest (a “Contest”) hosted by British Columbia Safety Authority dba Technical Safety BC (“TSBC”) is governed by the contest rules located on www.facebook.com/technicalsafetyBC/ (the “Short Rules”), and these rules (the “Contest Rules”). By participating or attempting to participate in a Contest, each entrant (an “Entrant”) agrees to be legally bound by the applicable Short Rules, the Contest Rules, and will be deemed to have read and understood the Contest Rules. Only Entrants who abide by the applicable Short Rules and the Contest Rules are eligible to win a prize in a Contest.  

Eligibility

Unless otherwise specified in the applicable Short Rules, a Contest is open to individuals who: 

  • are residents of British Columbia, Canada; and 
  • are of the age of majority in British Columbia. 

Employees, officers, or directors of TSBC (together with its parent, affiliates, subsidiaries, related and associated companies, successors, assigns), related advertising and promotional agencies and Contest prize providers (collectively referred to as the “Sponsors”) as well as their immediate families and persons living in the same household are not eligible to enter or participate in the Contest.  

TSBC reserves the right to require proof of identity and/or eligibility (in a form acceptable to TSBC – including, without limitation, government issued photo identification) to participate in a Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to TSBC for the purpose of a Contest must not be misleading and should be truthful, complete, and accurate. TSBC reserves the right, in its sole discretion, to disqualify any Entrant should such an Entrant at any stage supply information that does not meet these requirements. 

Contest Period 

A Contest will be open for entry during the Contest Period specified in the applicable Short Rules. In its sole discretion, TSBC may extend any period of time for entry.  

Entry

No purchase is necessary to enter or win a Contest. Unless otherwise stated in the Short Rules, there is a limit of one (1) entry per person per Contest. Entrants are required to enter a Contest through the method indicated in the applicable Short Rules. TSBC will not confirm receipt of any entries, and proof of submission of an entry will not be deemed to be proof of receipt. TSBC has no obligation to advise an Entrant of an incomplete or otherwise non-compliant entry.  

Entrant Agreement 

Entering or attempting to enter a Contest constitutes each Entrant’s full and unconditional agreement to be bound by the Short Rules, the Contest Rules and to any decisions made by TSBC, all decisions of which pertaining to a Contest shall be final and binding without any right of appeal. Winning a prize is contingent upon an eligible Entrant fulfilling all of the requirements of and adhering to all terms and conditions provided in the Short Rules and the Contest Rules. 

Odds of Winning

The odds of winning any prize depend on the number of valid entries received in accordance with the Short Rules and the Contest Rules.  

Winner Selection

The potential winner(s) of any Contest will be selected by random selection within five (5) business days after the Contest Period or other manner specified in the Short Rules (each a “Selected Entrant”). The Selected Entrant will be contacted using the information provided at the time of entry. In the event a Selected Entrant cannot be contacted within seven (7) days after the selection, as determined by TSBC at its sole discretion, or if the Short Rules and/or the Contest Rules are not adhered to by the Selected Entrant, the Selected Entrant will be disqualified, will forfeit all rights to the applicable prize, and another eligible Entrant may be selected (as determined by TSBC in its sole discretion). TSBC will not be responsible for the failure of any reason whatsoever of a Selected Entrant to receive notification or for TSBC to receive a Selected Entrant’s response.  

In order to be declared a winner (a “Winning Entrant”), each potential winner must first:  

  • correctly answer, unaided, a time limited mathematical skill testing question administered by TSBC;  
  • be verified as complying with the Short Rules and the Contest Rules (as determined by TSBC in its sole and absolute discretion); and  
  • sign and return within the time stipulated by TSBC a Declaration and Release form stating, without limitation, that the Winning Entrant (i) accepts the Prize as awarded; (ii) has read and understood the Short Rules and Contest Rules and complies completely; (iii) complies with the eligibility requirements; (iv) agrees to the use of their name, address (city and province) and/or photograph without further remuneration in connection with any publicity carried out by or on behalf of the Sponsors with respect to the contest; and (v) releases and agrees to hold harmless the Sponsors from any liability in connection with the Prize or any portion of the Contest. The Declaration and Release form must be returned within the time period specified on the form or the prize will be forfeited.  

If a potential Winning Entrant incorrectly answers the mathematical skill-testing question, declines the prize, or is otherwise found to be ineligible, the prize shall be forfeited and TSBC has the right, at its sole discretion, to select another potential Winning Entrant.  

If, due to printing or programming or production or transmission or other errors or omissions or for any other reason whatever, there are more than one (1) potential Winning Entrants coming forward seeking to claim a prize, the actual Winning Entrant, in the sole discretion of TSBC, may be selected in a random drawing from among all persons making purportedly valid claims for a prize.  Inclusion in such drawing shall be the sole and exclusive remedy in such circumstances for any eligible Entrant who has submitted an entry into a Contest. 

PRIZES: Winning Entrants will be contacted by TSBC with instructions on how to claim the prize. Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of TSBC. TSBC reserves the right, in its sole discretion, to substitute a prize of equal or greater value if the prize (or any portion of it) cannot be awarded for any reason. Any expenses which are applicable to the prize, and which are not expressly included in the description of the prize in the Short Rules or the Contest Rules are the sole responsibility of the Winning Entrant. If the Winning Entrant cannot accept the prize as stated, the prize will be forfeited in its entirety. 

If the Winning Entrant fails to take delivery of any prize as instructed, such prize may be deemed forfeited and TSBC reserves the right, in its sole discretion, to select another eligible Entrant as a potential winner.  

Change to or Termination of a Contest

TSBC reserves the right, in its sole discretion, to cancel, modify, or suspend a Contest or amend the applicable Short Rules or these Contest Rules at any time, for any reason whatsoever.  

Conduct

TSBC reserves the right, in its sole discretion, to disqualify any Entrant found to be: (a) violating the Short Rules or the Contest Rules, (b) tampering or attempting to tamper with the entry process or the operation of a Contest, a Contest website, or any related promotional website or application; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any TSBC property or service; and/or (d) acting in an unsportsmanlike or disruptive manner with intent to undermine the legitimate operation of a Contest, or to annoy, abuse, threaten or harass any other person. Any attempt to deliberately undermine the legitimate operation of a Contest may be a violation of criminal and civil laws. If such an attempt is made, TSBC reserves the right to seek remedies and damages to the fullest extent permitted by law, including but not limited to criminal prosecution. Where applicable, Winning Entrants must at all times behave appropriately when taking part in the prize and observe the Short Rules, the Contest Rules and any other rules or regulations in force at any prize-related locations.  

Personal Information

By participating in a Contest, each Entrant: (i) grants the Sponsors the right to collect, use and disclose their personal information for the purpose of administering the Contest, including but not limited to contacting and announcing the Winning Entrant and coordinating provision of the prize(s); (ii) grants the Sponsors the right to use their personal information for publicity and promotional purposes relating to the Contest in any and all media without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsors may disclose their personal information to third-party agents and services providers of the Sponsors in connection with any of the activities listed in (i) and/or (ii) above. TSBC will use the Entrant’s personal information only for identified purposes and protect the Entrant’s personal information in a manner that is consistent with the TSBC privacy policy at: https://www.technicalsafetybc.ca/privacy-policy.  

Release and Indemnity

By entering a Contest, each Entrant releases and agrees to indemnify and hold harmless the Sponsors from all liability of any kind relating to the Contest or their participation therein, including, without limitation, all claims, demands, actions, causes of action, suits, debts, covenants, contracts, costs and expenses, including legal fees and related expenses, of whatever nature or kind, including but not limited to claims based on negligence, breach of contract, printing errors or omissions, publicity rights, defamation, and liability for injury, accident, damage, claim, loss, misfortune, death, or property damage, which any Entrant or third party has, might have, or could have with respect to or in any way related or connected to any aspect(s) of a Contest, by reason of or arising out of the Entrant’s participation or attempted participation in a Contest and compliance or non-compliance with the Short Rules, the Contest Rules, and/or in connection with the awarding, acceptance, delivery, possession, use, and/or misuse of the prize awarded and any travel by a Entrant to claim the prize.   

Limitations of Liability

The Sponsors assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. The Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing or otherwise. The Sponsors are not responsible for any injury or damage to any Entrant or to any computer related to or resulting from participating or downloading materials related to a Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any prize. The Sponsors assume no responsibility or liability in the event that a Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of a Contest and/or a Contest website. 

Law

The Contests are subject to applicable federal, provincial, and municipal laws and regulations. If any term or condition of the Short Rules or Contest Rules is invalid, illegal or unenforceable, such invalidity, illegality or unenforceability shall not affect any other term or provision of the Contest Rules. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between one or more persons who participate in a Contest and TSBC in connection with a Contest shall be governed by and construed and interpreted in accordance with the laws of the Province of British Columbia, Canada, including the procedural provisions of those laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  All persons who participate in a Contest, the Sponsors, and all other parties hereby attorn to the jurisdiction of the courts of the Province of British Columbia, sitting in the City of Vancouver, British Columbia, in respect of the determination of any matter or dispute arising under or in respect of a Contest or arising under or in respect of the Short Rules or the Contest Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of British Columbia. 

Intellectual Property

All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and representations used in a Contest are the property of TSBC or any applicable Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.  

Discrepancy With Other Media

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any website or advertising or form or other publicity or materials concerning a Contest and the provisions contained in the Short Rules or the Contest Rules, the provisions in the Short Rules and the Contest Rules shall prevail, govern and control.   

Social Media

This Contest is in no way sponsored, endorsed, administered or associated by any social media platforms on which the Contest may be promoted and/or publicized, including but not limited to Facebook (Meta) and/or Instagram. By entering a Contest, each Entrant agrees to release and hold Instagram and Facebook (Meta) harmless from and against any and all losses, damages, right, claims, and actions of any kind arising in whole or in part, directly or indirectly, from a Contest or participation in any Contest-related activity, or from acceptance, possession, use or misuse of any prize awarded in connection with the contest, including without limitation, personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
