Information Bulletin: Declarations and Request for Acceptance Inspection

Topic: Procedures for submitting declarations and requesting an acceptance inspection

This bulletin provides instruction to contractors and mechanics when submitting declarations and requesting an acceptance inspection. Recent changes to the Elevating Devices Safety Regulation (EDSR), effective April 30, 2020, require elevating device contractors or mechanics to submit declarations and request an inspection by a safety officer upon completion of a new elevating device, or upon the completion of an alteration to an existing elevating device.

 Per the requirements in section 12 of EDSR, contractors or mechanics must do the following.

1. Declaration of compliance
   1. Upon completion of any newly installed elevating device or the completion of a major alteration to an existing elevating device, the contractor or mechanic who completed the work must submit a signed declaration, confirming that all work complies with the Act, regulations and applicable codes.
   2. Upon completion of any type of minor alteration to an existing elevating device, the contractor or mechanic who completed the work must, within 30 days of completion of the work, submit a signed declaration, confirming that all work complies with the Act, regulations and applicable codes.
2. Request for inspection, new installation or major alteration
   Upon completion of any newly installed elevating device or the completion of a major alteration to an existing elevating device, the contractor or mechanic must do the following. 
   1. Request an acceptance inspection by a safety officer
   2. Submit a signed declaration before commencing an acceptance inspection.
   3. Wait until an acceptance inspection has been completed by a safety officer, or have permission granted by a safety manager, before putting any newly installed device or device that has undergone a major alteration into service.
       
3. Request for inspection, minor alteration
   Upon completion of a minor alteration to an existing elevating device, the contractor or mechanic who completed the work must do the following. 
   1. Within 60 days of returning the device to service, request a safety officer to conduct an acceptance inspection.
      
      NOTE: In the case of minor alterations, the contractor should reference the major/minor alteration directive to determine which minor alteration is required to have an acceptance inspection.
       
4. Acceptance inspection
   Where an acceptance inspection is to be conducted, the contractor or mechanic making the request for an inspection must do the following. 
   1. Make available a certified elevating device mechanic to perform any relevant tests in respect to the acceptance inspection.
   2. Prior to the acceptance inspection, provide any additional information which is relevant to the acceptance inspection. Additional information may include, but is not limited to:
      1. General contractors pre-inspection check list
      2. Elevator contractors pre-inspection checklists
      3. Firefighters’ emergency operation checklist (see A17.2)
      4. Manufacturer’s drawings,
      5. Manufacturer’s redundancy and test procedures
      6. Engineering tests, type tests and certifications

35 (1) In this section, "declaration of compliance" means a declaration or notice that, or another form of statement indicating that, regulated work complies with the Act and the regulations.

(2) A person who is required under a safety regulation to give a declaration of compliance to a regulatory authority, provincial safety manager or safety officer

(a)must not give the declaration of compliance unless the person has first physically inspected the regulated work that is the subject of the declaration, and

(b)must confirm both of the following in the declaration of compliance:

(i)that the person has personally inspected the regulated work;

(ii)that the person believes, based on their inspection, that the regulated work complies with the Act and the regulations
